The following are my responds to the eight questions found on page one and two of that letter.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Respond to Question One.&lt;br /&gt;&lt;br /&gt;Yes I had transmitted on the frequency of 13.556.00 Mhz. between the months of August to late November of 2006. But since that time Omega One Radio has NOT been on the air. &lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Respond to Question Two. &lt;br /&gt;&lt;br /&gt;As stated above the frequency Omega One Radio was operated on was 13.556.00 Mhz. The power level we were operating at is found under 47 CFR 15.225(The field srtenght of any emission within the band 13.553 to 13.567 MHz. shall not exceed 15,848 uV/m @ 30 meters) and NOT the field strength in your letter of 30 micorvolts/meter at 30 meters.(47 CFR 15.209)&lt;br /&gt;&lt;br /&gt;Respond to Question Three.&lt;br /&gt;&lt;br /&gt;The Transmitter was a homebuilt made from an assortment of radio Parts. (Some amateurs do know how to build their own radios.) I started working on it in January of 2006, I didn’t have a job at the time and it gave me something to do. I finished it in late July and it went on the air in August. The Antenna was a homebuilt antenna as well made from dynamite wire and cut for 13.556.00 Mhz. The wire was strung across the yard at a height of three to four feet off the ground. I was originally using an Alpha Delta Wire but it had a bad wire (it had been hit by lightning a number of times) which was up 50 feet and I switched it out for the antenna made from dynamite wire. &lt;br /&gt;&lt;br /&gt;Respond to Question Four&lt;br /&gt;&lt;br /&gt;The transmitter stated above was a homebuilt and does not have a “Specification Sheet”. Under Part 15 hobbyist and inventors are allowed to build up to five transmitters without certification or verification by the FCC if they are marketing and are for “personal use” (47 CFR 15.23) &lt;br /&gt;&lt;br /&gt;Respond to Question Five&lt;br /&gt;&lt;br /&gt;I am the sole owner and operator of Omega One Radio. Omega One began in August of 2006 after I inquired to the International Bureau about obtaining a shortwave broadcast license and a waiver. The Chief of the International Bureau replied via email and informed me that “they do not consider waivers” despite the fact that courts has stated that the FCC “Must consider waivers” (See WAIT RADIO v FCC (1969). So I searched through my copy of Part 15 and looked for a band that had the largest field strength and found it on 13.556. Thus Omega One Radio began operating in August of 2006 and ended in November of 2006 after the hard drive on the computer went bad. Again Omega One was a low power (Part 15) station with a homebuilt transmitter and was hooked to a homemade audio cable which was hooked into an iMac G5 Apple Computer. The Antenna was as stated before a wire antenna made from dynamite wire strung across the yard at a height of three to four feet off the ground.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Respond to Question Six. &lt;br /&gt;&lt;br /&gt;O’Dochartaigh is the Gaelic spelling of my last name. The only time I used that spelling was when I was on the internet and had signed my name that way on a few Usenet. Last time I checked the FCC had no jurisdiction over the Internet and therefore how I sign my name on the Usenet is none of the FCC concern. Secondly as fourth generation Irish in this country I find it insulting and a form of discrimination on the FCC part because I might want to spell my name the Gaelic way on the freaking internet!&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Respond to Question Seven&lt;br /&gt;&lt;br /&gt;Langley Park Studio’s/ Langley Park Telecommunication began in the 1980’s as a group to promote theater, and the performing arts. In the 1990’s we placed telecommunication into as well. Langley Park is a non-profit club that teaches anyone at any age theater, telecommunication and the performing arts. We are a club we have are club meeting after the Christian County Amateur Radio Club meeting, because a lot of amateur operators are members of Langley Park.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Respond to Question Eight&lt;br /&gt;&lt;br /&gt;Yes, I had applied seven times for a broadcast license with waivers, both under my name and under Langley park Telecommunication. In 1998 to 1999 I applied six times for a Low Power Television license (LPTV) with waivers(file number 1800E2-EBK) and each time I applied for a license with waivers the FCC would return them claiming I didn’t file during a filing window(see Attachment A, In re: Application for new LPTV station Todd E. Daugherty, Channel 14 Taylorville, Illinois) Despite the fact that we have waivers("Waivers may be consider at anytime if good cause is shown (47 CFR 1.3) and the courts has stated that the FCC must take a hard look at waivers(See WAIT RADIO v FCC (1969), See Turro V FCC (1988), See Rio Grande Radio Fellowship Inc v FCC (1968), See United States v Storer Broadcasting Co. (1956), See United States v Dunifer (1998). In 2000 Langley Park Telecommunication applied for a Low Power FM (LPFM) license with waiver(File number BNPL-20000828ACC) and again the FCC dismissed the application and waiver.(See FCC 01-100) Langley Park Telecommunications or it’s members has NEVER had a “Specified Finding” before the FCC. Langley Park Telecommunications did not get the right to pled their case before the FCC or bring up the fact that the FCC never consider their applications or waivers prior the LPFM application.&lt;br /&gt;&lt;br /&gt;Conclusion&lt;br /&gt;&lt;br /&gt;If you wish to proceed to go after me for a lower radio station under Part 15, then go for it! I will challenge it in the courts. I want the FCC to go to court and explain why they LIED all these years about the waiver process. I want the FCC how they SCREWED me out of licenses. I also want the FCC explain why they are going after a Part 15 station, which isn’t even on the air, but are allowing amateurs to abuse and harass other amateur radio operators and purposely and maliciously interfere with stations on the air and explain why these individuals still have a license. It is these same individuals who informed the FCC about my Part 15 station and it is these same individuals who had me kicked off of ever service provider in my area “banning” me from the Internet. So here’s a suggestion either consider my waivers and applications or dismiss this, because I will fight it!&lt;br /&gt;&lt;br /&gt;I declare under penalty of perjury under the laws of the United States of America that the foregoing is true and correct. We believe the hum is accually coming from the interface, which goes between the computer and radio. We are working on a new interface to eliminate this problem, if it isn't the interface then it's the power supply giving off the hum. OMEGA ONE radio runs around 100 watts but what amateur seem to lack is the understanding that it is voltage (measured in microvolts) that the FCC is looking at not wattage. Why's this?? because it is the electrical field of the electromagnetic wave that causes harmful interference and a wattage can produce different electrical fields depending on many factors like length of coax, line loss in the coax, antenna, antenna height, db gain, and other factors. You can run 50,000 watts and still put out a field that produces a Part 15 Field and you can do this by two ways...the first is to bury the coax and antenna down deep enought to damper the electrical field, the second way is to run that power into a dummy load. BUT LORD IF MERCY IF THE HAM OPERATORS dont know how to do stuff like that. For battery operated equipment, the equipment tests shall be performed using a new battery. &lt;br /&gt;(f) In the case of radio frequency powered tags designed to operate with a device authorized under this section, the tag may be approved with the device or be considered as a separate device subject to its own authorization. The truth is Omega One Radio is Legal. The power output of Omega One is 10,000 uV/ meter @ 30 meters(47 CFR Part 15.225). What's even worse is that this Ham operators are accusing someone of an illegal activity without even reading the rules and regulations. When Todd N9OGL, posted the rules those amateur's claimed "Just another cut and paste by Todd". The truth is most amateur radio operators don't know the rules, sometimes even their own rules. They believe that ALL radio transmitters and operators must be licensed by the FCC.They also believe that If you need to know about a rule or regulation that you have to be a lawyer or ask a lawyer to understand what those rules mean. This in term show how bad amateurs really are, it shows that amateurs want to play radio cop and jump the gun without reading and doing research on the matter.
